Orenthal James . Simpson was one among the America’s premier top professional and college football players between 1960 and 1970 but by 1990’s he was well known not for his football acumen but for his part as the defendant in one of the most commemorated murder trials in the 20th century in legal annals of America. In 1970s, Simpson participated in the National Football League and was regarded as one of the supreme running supports in the history of professional and college football. Simpson was awarded All American honors in 1967 and 1968 and won the 1968 Heisman Trophy.

On June 12, 1994, Nicole Brown Simpson, who was Simpson’s ex-wife and her boy friend Ronald Goldman were stabbed to death and their dead bodies were found to be lying in the front courtyard of the Nicole’s apartment in Brentwood. Simpson who was on a business trip in Chicago was apprised on the next day of the murder and was taken in for questioning.
After seven years of marriage, Simpson divorced his wife in 1992. Simpson was charged with domestic disturbance early in 1989. According to Police, Mrs. Simpson made a complaint to them of his motive to kill her. In this case, Simpson implored no challenge. Finally, he was ordered to carry out 120 hours of community service, to undergo psychiatric therapy and asked to pay a fine. The main aim for non- challenging by Simpson was generally to resolve the matter and keep it personal. . Robert Shapiro was appointed as defense counsel by Simpson.
When the police contemplating to arrest Simpson on June 17, 1994, he slipped and he was chased by the police and was finally taken into custody when he returned to his house at Rockingham. After six day initial hearing, Simpson was charged with two counts of first-degree trial. Simpson implored about his complete innocence and pleaded for an absolute 100 % not guilty in the case. In Simpson case, twelve jurors heard the case for more than a year through a trial that took cognizance of more than 50,000 pages of evidence, a majority of which was comprised of scientific evidence.
During the trial sentence period, Simpson occupied a small cell in striking distinction to the luxurious environs of his $ 1. 5 million Brentwood mansion. Thus, Simpson who was a renowned football player, TV pitchman for sports and broadcast journalist had been compelled to live in a small prison cell with only a sink, a bed and a toilet. One of the main witnesses of the case, Mark Fuhrman who testified that he spotted a knife box on the ridge of the bath tub and it was not taken for evidence. Prosecution was of the view that they retrieved the knife from the box but didn’t think that box was also to be produced as evidence in this case.
Further, the witness Mark Fuhrman testified that he witnessed some finger print on the gate of Nicholas residence, but prosecution was failed to produce the same. On the prosecution side, they failed to establish the crime with strong evidence. In case of crime like murders, the offender is likely to leave evidence without his knowledge like fibers, hair, gun shot residues etc . These are known as trace evidence which cannot be identified with an unaided or single-handed eye. In Simpson case, there were plenty of trace evidence which the prosecution failed to assimilate and produce before the court.
One drop of blood from the hand glove was located at Simpson’s estate. Further as per analytical report from Bruce Weir , a genetic statistician revealed that four blood drops were traced from the White Ford Bronco console and this had confirmed that blood could have emanated from as a minimum of twice as many persons . Though ,Prosecution side had the strong DNA analysis proof that blood soaked socks found in the Simpson’s bedroom were testified to be Nicole’s blood , it had failed to use this to convince the court .
Prosecution failed to convince the court as regards to the finding that DNA analysis of blood seen on the gloves was the combination of blood of Nicole, Simpson and Ronald Goldman. The court was not properly appraised by the prosecution side about the fact that the gloves contained particles of Nicole’s boy friend hair and Simpson’s Bronco carpet fiber. One another mistake done by the Los Angles police department was that when they received the call about the murder, they alerted all the investigators to rush to the spot. As the result, as too many cooks spoil the broth, too many investigators to find evidence had in fact dislodged the same.
Further, the statement made by Susan Brockbank, a Los Angel Police department criminologist, that she collected trace evidence and hair at the crime sight and also collected trace evidence from the victim’s dresses and also from cap of the murderer which was found at the murder sight. She also affirmed that she collected a towel, a hair from a brown checkered cap and also a spade found in O. J. Simpson’s white Ford Bronco. She also established that the cotton fibers found at the crime scene was analogous with the carpet in the Simpson’s Bronco which was on the hand glove at Rockingham.
All the evidence collected at the crime scene and at the time of murder pointed the finger to Simpson and even defense side had not repudiated the same. In this case , immense DNA evidence were gathered that all pointed fingers towards Simpson but there was skepticism that records were tampered by the Los Angels Police department and this facilitated Simpson to be set off by the jury. In Simpson case, there was allegation against Los Angel’s police that they brought a mound of substandard and maneuvered evidence during the trial and this was the main reason for the finding by the Jury that Simpson was an innocent.
Prosecution made a great blunder by asking Simpson to try on the glove as glove was used frequently in the experiment conducted in the DNA laboratories and had lost its originality . as it had shriveled. When the glove found to be too tight when Simpson tried the same on his hand, it was a great blow to the prosecution side. Prosecution was erred to convince the Court that Simpson had in earlier occasion of teasing and beating his wife Nicole and for this, he was punished by the court.
Prosecution failed to bring to the attention of the Court about the retrieval of one set of key from Simpson home that was reported as missed by the Nicole in earlier occasion. One another evidence was that perfect matching of left-hand glove that was found at the scene of the murder and right hand glove found in Simpson house. At the scene of murder, police found that there were footprints with blood from a pair of Magli shoes and its size was 12 prints. Police submitted to the court that it confirmed with favorite brand of Simpson and the size also perfectly matched with Simpson shoe’s size.
Prosecution failed to convince the court that these shoes were quite costly and never used by common man. Under the statement oath, Simpson submitted that he never used such costly shoes but later photographs were produced to reaffirm the veracity of the facts. Simpson wisely submitted that the Photo was forged one and backed up by a specialist witness. Prosecution was failed to corroborate the Nicole’s statement to her friends that Simpson had warned her that he would kill her if he find her with another man. Police obtained the receipt from Ross Cutlery about the purchase of knife by Simpson six week before the murders.
Police also established that there existed precise match to the cuts on the Nicole’s and Goldman by purchasing facsimile knife from Ross Cutlery. Prosecution mocked the Simpson statement that he suffered cuts in the left hand in an accident at his residence which caused the blood bleeding and hence his glove had blood stains. Prosecution also tried to establish of the motive of the murder by Simpson as he wanted to take revenge. The submission made by the prosecution was short of sense and it had failed to establish Simpson’s guilt beyond doubt. On the defense side, they were very cautious. While commenting on the release of O.
J. Simpson, the defense side commented that what the jury did was the right thing rather than observing that that their client was guiltless. One another thing make us puzzling that no search was made for the real culprit after Simpson was found innocent. Defense attorney Professor Alan Dershowitz argued that there were about 2 million spousal ill-treatment confrontations in the United States annually. But, as per statistics, the murder of any American by their spouses is only around 2000 annually. In other words, only a 1 –in-1000 probability that a man who pounds his wife will kill her was put forth by Attorney Dershowitz.
However, Judge Ito did not accept this argument. The defense attorney was successful in his endeavor to influence the jury that the case was mainly initiated to on the racial discrimination ground and not on the homicide. Further, defense lawyers argued that Simpson was the sufferer of fraud devised by police and due to shoddy internal procedure that polluted the DNA evidence. Further, Defense team argued that Los Angel’s police department detective Mark Fuhrman had planned and implanted evidence at the crime scene as he was already proved to be a racist.
Defense was able to establish that there were small traces of preservatives applied in the crime labs on the Brown’s sock and this was submitted under notion that this was fake evidence. Defense was successful in establishing that there was lack of evidence to prove that Simpson had murdered the Nicole and her boy friend. Further, blood sample which was drawn from Simpson on June 13, 1994 was not immediately booked by the Los Angels police department. Instead, they carried it to Simpson’s estate where criminalists gathering evidence. The defense argued that intention of police was evidence planting.
The defense was successful in establishing that Mark Fuhrman, the police detective was a racist and a liar which turned the case in favour of Simpson. Defense side had able to demonstrate on the veracity of prosecution’s scientific evidence like DNA by arguing that most of the evidence was planted and the balance was damaged by contamination. Finally, Simpson was not established to be innocent but rather not found to be guilty. He was found by the jury that he was not guilty of the felony of murder in violation of section 187A of the Penal Code.
No doubt, money played an overriding role in this case. Simpson had money power to buy the best defense lawyers for him who rallied for him to free him from the gallows of the death with their legal skills and acumen. Though Simpson was exonerated from the criminal case but he was not succeeded in a civil case. In the civil case, he was found responsible for the 1994 deaths of his ex-wife and her boy friend and was ordered to defer the victim’s families $33. 5 million. O. J. Simpson case is an eye opener on many grounds. The salient features were listed below: ] Though the prosecution had enough evidence, it had failed to prove beyond doubt that Simpson had committed the murder. 2] Defense was well prepared and had attacked the loopholes of the prosecution side aptly and promptly. Further, as a lost weapon on the prosecutor’s arsenal, defense side raised the racist issue and police’s evidence planting which made fissures on the prosecution’s argument of the case. 3] Simpson case prove that any one can make murder and still let loose by the American judicial system , if the culprit is an acclaimed person with money background who can buy best counsel to free him from the indictment .
